According to DotD, a strange constellation of leaks gamesmanship and ego has lead an immigration attorney to withdraw an immigration appeal, fearing that the Ninth Circuit would (for whatever boneheaded reason) decide accord greater deference to IJs.
This is a very important decision simply because of the
backstory. California Appellate Report comments here. Kozinski doesn’t seem to get that – of course – precedent is,
and will be manipulated. The government
does this all the time. There is nothing wrong with it. It is called "policy." But they do have more style when they do it.
