Boukhtouchen v. Gonzales, No. 06-2587 (unpublished). The petitioner is an Algerian Berber. And a Federalist! (Well, an Algerian Federalist, but he could I guess, join the Federalist Society, right?) The First affirms a denial of asylum, because the level of political harassment wasn’t that high. The petitioner, however argues, that the BIA didn’t take his appeal seriously, but the First says it did a good enough job.
