Osorno v. Gonzales, 05-1279 (unpublished). The BIA dismissed an appeal of an IJ
decision, holding that “Osorno had not presented sufficient evidence to
establish past persecution on account of a protected ground.” A motion for reconsideration, arguing that
the BIA had improperly relied on the IJ’s credibility determination was denied. Because he waited to long to appeal the BIA’s
underlying decision, only the petition for review is at issue. But, this motion didn’t identify any factual
issues that were missed or any changes in law.
