US v. Bradley et. al., No. 04-1146, No. 04-1147. We originally covered this case here. It involves forced labor. The defendants got a GVR from the Supreme Court on Booker grounds, and, on plain error review (as Booker wasn’t preserved below), the court concludes that since they were sentenced near the bottom of the guidelines, “This may often be a persuasive argument against a remand but it cannot be so in every set of facts.... This case is a very close one but, on balance, we think there is enough of a possibility of a different result that we have concluded that a remand is appropriate.”
