United Teachers Associates v. Union Labor Life Insurance Co. (King, C.J.)
The Court considers whether the failure to disclose information can constitute fraud under Texas law absent a confidential or fiduciary relationship. After much discussion, the Court declines to decide the issue because the plaintiff could not prove that the defendant acted with fraudulent intent.
The Court also considers whether the district court erred in granting additional monetary relief when it granted the defendant's claim for a declaratory judgment pursuant to 28 U.S.C. Section 2202.
