A number of people have wondered where they can find copies of various Office of Legal Policy memos from the Reagan administration.
The “Truth in Criminal Justice” series can found at 22 U. Mich. J.L. Reform. You can get them from Heinonline or directly from Hein. I don't think that these are the best work of that office, but they may be of some help. Most of the other ones can be found here. They are a great resource, and also frequently cited by the government or opposing counsel. And they are public domain. Keep readin’.
These “Report[s] to the Attorney General on the...” found in 22 U. Mich. J.L. (1989) are:
- Law of Pretrial Interrogation
- Search and Seizure Exclusionary Rule
- Sixth Amendment Right to Counsel under the Massiah Line of Cases
- Admission of Criminal Histories at Trial Truth in Criminal Justice' Series
- Report to the Attorney General on the Judiciary's Use of Supervisory Power to Control Federal Law Enforcement Activity
- Double Jeopardy and Government Appeals of Acquittals
- Federal Habeas Corpus Review of State Judgments
- Adverse Inferences from Silence Truth in Criminal Justice' Series
A number of other “Report[s] to the Attorney General” are found on case.tm, and provide a far better overviews of a number of issues while taking care to distinguish between litigating positions and general theory:
- A New Look at Plurality Decisions.
- The Constitution in the Year 2000 : Choices Ahead in Constitutional Interpretation.
- Guidelines on Constitutional Litigation.
- Religious Liberty under the Free Exercise Clause.
- Using and Misusing Legislative History: A Re-Evaluation of the Status of Legislative History in Statutory Interpretation.
- Wrong Turns on the Road to Judicial Activism : the Ninth Amendment and the Privileges or Immunities Clause.
It's hard to believe anyone is actually asking for these.
I found this post by search for an online copy of the report I wrote in my previous life (Using and Misusing Legislative History). Thanks for the link to case.tm, and thanks for the generally nice words.
