The USSC issued a press release which concludes:
As the opinion in Booker/Fanfan states, the Commission ‘remains in place’ and will continue to fulfill its statutorily mandated functions such as collecting sentencing data from all federal district courts, amending the guidelines where appropriate, and conducting sentencing-related research.
No mention of pending cases which claim that the post-Feeney makeup of the commission is unconstitutional. (See, e.g., United States v. Detwiler, CR 03-372-PA (D. Or. Oct. 5, 2004) and the discussion at SL&P)
