Teng v. Mukasey, No. 07-1224. In this immigration case, the petitioner is a Cambodia that was oppressed by Pol Pot and his ilk. Before the First is the CAT claim and the withholding claim. Everyone seems to agree that Cambodia is now a much nicer place then it was, and any recent violence wouldn’t really be enough to show persecution.
The First seems to come close to say that the IJ was not doing that good a job, but ultimately affirms him, so whatever critiques of the IJ will fall on deaf ears.
