Lopez v. Commonwealth of MA, No. 06-1663. This case affirms the denial of a writ of habeas corpus. The petitioner raised mainly claims under Brady v. Maryland, 373 U.S. 83 (1963). Unfortunately, the First is just teasing us, with issues of delayed v. absent disclosure, because it says that the problems would not have been prejudicial. Strangely, it then concedes that the evidence was circumstantial, and based on questionable confessions to cellmates. However, there was other stuff, like forensic evidence, and some motive stuff. Even stranger the First says, “We understand why the district court held a hearing but our confidence in the verdict is not at all shaken.”
