Villanueva-Méndez v. Nieves-Vázquez, No. 05-1638, is an appeal of a Puerto Rican political discrimination that was decided on a statute of limitations issues. The court holds that a claim under § 1983 accrued at the time the plaintiff received notice of a less-than-preferred new assignment which was really the “ousting” as a park director, and replacement with a political appointee. The court questions whether the plaintiff was really entitled to protection against political discrimination, but doesn’t resolve it.
